حق الاختصاص هو حق عيني تبعي يتقرر بموجب امر ولائي يصدر من محكمة
مختصة لمصلحة الدائن حسن النية تنفيذا لحكم قضائي واجب النفاذ، بإلزام المدين بالدين
على عقار او اكثر من عقارات المدين، يمكنه من استيفاء حقه من ثمن العقار او اي مال يحل
محله متقدما على الدائنين العاديين والدائنين التالين له في المرتبة، في اي يد يكون.
اشترط المشرع في التشريعات المقارنة تسجيل هذا الحق من اجل شهره بما يضمن
حق الدائن، واعلام الغير بالمركز القانوني للعقار وهو اجراء لابد منه كي يسري حق
الاختصاص في مواجهة الغير فيستفيد الدائن من مزيتي التقدم والتتبع التي تميز الحقوق
العينية التبعية

The right of jurisdiction is an accessory real right decided by virtue of a
state order issued by a competent court in the interest of a bona fide creditor in
implementation of an enforceable court ruling obligating the debtor to owe the
debt on one or more of the debtor’s real estate enabling him to fulfill his right
from the price of the property or any money that replaces it, taking precedence
