ان للقاضي الإداري دور مهم في الرقابة على قرار فرض العقوبة الانضباطية، سواء
بالنسبة للإجراءات السابقة على فرض العقوبة او في المرحلة اللاحقة لفرض العقوبة.
وان ابرز صور الرقابة السابقة، هي رقابة القضاء على تشكيل اللجنة التحقيقية
وكيفية عملها نظراً لما لها من دور في الكشف عن مدى ارتكاب الموظف للمخالفة.
وكذلك فإن للقضاء دور بارز في البحث في مشروعية قرار العقوبة الانضباطية، وله
سلطة واسعة تجاه القرار الصادر
